Environmental Litigation

At HKM, we take a proactive, well-reasoned approach in defending our clients against environmental claims. Our Environmental Practice Group has extensive and broad-based experience in the handling of environmental claims. This experience, coupled with creativity and determination, places our clients in a position to successfully and favorably resolve environmental law disputes brought against them – whether asserted by a governmental agency, or private entity.

When a client faces an environmental claim, our environmental lawyers respond with a thorough case investigation and strategic plan of action. We work diligently to assess the particular strengths and weaknesses of each case. Working together with the insured or uninsured client, the client’s management team, appropriate in-house and/or outside technical support, as well as our own experiential resources, we strive to obtain and deliver the client’s desired outcome.

HKM represents companies involved in a wide variety of environmental issues. Whether the claims and issues involve pollution or contamination of soil, groundwater, surface water, air, or natural resource damages, HKM has the depth and know-how to counsel, defend and obtain favorable results for companies or individuals facing such claims.

Our Environmental Practice Group is well-versed in the requirements of local, state and federal environmental laws and regulations, including federal RCRA or CERCLA claims or equivalent Minnesota state MERLA claims, but also including the more mundane claims resulting from surface or subsurface contamination, spills, releases, or discharges into the environment as well as the sometimes resulting claims of vapor intrusion.

With attentive environmental lawyers proactively addressing the vital components of each case, clients may rest assured that their vital interests will be protected in these matters.

Experience in defending clients in Minnesota and Wisconsin involved in environmental claims at both the state and federal level include, but are not limited to, the following:
  • Ground water contamination
  • Surface water contamination
  • Soil contamination
  • CERCLA – Federal EPA Superfund
  • MERLA – Minnesota Superfund
